College is more than just a place to get a good education and, eventually, a job; it is also a chance for young people to learn about themselves and how they fit into the world. For many students, this is their first opportunity to live away from their parents. Unfortunately, there are too many instances of sexual misconduct, with many victims left to figure out how to deal with the issue.

If you are a survivor or the parent of a victim, know that you have rights under specific laws to file a complaint against the perpetrator. Our skilled team of school and university sexual abuse attorneys at The Cifarelli Law Firm help victims with Title IX sexual abuse claims in Irvine. Depending on the circumstances, you may be able to hold the school responsible for noncompliance with the law. Contact us today to schedule your consultation and learn how we could support you.

What Is Title IX?

Passed in 1972, Title IX is the ninth part of the Education Amendments, which is a landmark civil rights law. The individual parts of the law apply to all levels of education, from elementary school to college. Title IX specifically prohibits discrimination and harassment because of a person’s sex or gender.

Although it is commonly associated with colleges and universities, it actually applies to any educational institution or activity that receives federal funding. This could include local school districts, vocational schools, possibly even libraries and museums. The wording is broad, but it generally covers:

  • Sexual assault and rape
  • Domestic violence
  • Dating violence, such as stalking
  • Anything related to pregnancy or childbirth
  • Equal opportunity to participate in athletics

The law also protects students and staff who report any of these violations from retaliation. All institutions in Irvine must appoint a special Title IX coordinator to handle any claims that arise, such as sexual violence or exploitation by another student, and ensure compliance with the law.

Filing a Title IX Complaint

Like other matters involving federal law, the first step in such cases involves filing a complaint with the school’s coordinator. Title IX requires the institution to conduct its own investigation and attempt to resolve.

Sadly, it is not uncommon for schools in Irvine or their designated Title IX coordinators to drag their feet when it comes to sensitive topics, such as sexual abuse, and it may be necessary for the victim to take the next step and prepare separate claims. The victim may file a complaint with the US Department of Education’s Office for Civil Rights, the agency responsible for Title IX. This office takes noncompliance very seriously, and the institution could risk losing its federal funding.

The victim also has the option of filing a private civil lawsuit against the institution. In this situation, the institution’s failure to fully investigate Title IX violations or provide adequate protections as required could be the basis of a case. This could result in financial compensation for lost tuition, lost educational opportunities, and associated medical bills.
